The 79-year-old singer had asked the court to appoint a conservator to manage Allman’s estate, but the bid was rejected without prejudice, leaving open the possibility that she could try again in the future, per People.
Allman, 49, appeared via video call from a psychiatric hospital on Friday, where he is currently in custody 'in an attempt to restore him to competency' as he faces criminal charges in two separate cases.
Cher had argued that her son is 'gravely disabled' due to ongoing mental health and substance abuse struggles.
However, the judge said she did not see 'sufficient urgency' to grant the request.
The ruling also noted that, since Allman is hospitalized and facing legal proceedings, it is unlikely he would be able to access funds from his late father Gregg Allman’s trust.

Court documents obtained by the Daily Mail on Friday reveal that Allman objected to Cher’s attempt to place him under conservatorship.
The papers also include a declaration from his brother Devon Allman, who wrote: 'It is my opinion that [Elijah] is currently a danger to himself and unable to manage his life, and any funds that would become available to him.

Sources indicate that Allman has no known ties to the school and that it is unclear why he was on campus, per the outlet.
The incident follows a troubling health scare in June 2025, when Allman was .
In 2014 Allman revealed he began using drugs, like weed and ecstasy, at just 11-years-old and detailed some close calls.
'I [was] just looking to escape all the things in my past and, that's when you turn to those kind of drugs, you know heroin and opiates,' he told ET at the time.

He added, '[Heroin] kind of saved me … If I didn't have that at that point, I don't know what I would have done …You may jump off a bridge. If you can only just go through that time period and live through it and then get help.'
In early 2024 a judge threw out Cher's initial bid to have her son placed in a conservatorship controlled by her.
She had petitioned LA Superior Court to appoint her as Elijah's temporary conservator, arguing that his drug addiction, plus mental and physical health issues, made him unable to manage the $120,000 a year he gets from a trust fund set up for him by his late father.
Cher said she feared he would spend his $10,000 a month payouts on drugs, putting his life in jeopardy.
Judge Jessica Uzcategui refused to appoint Cher as conservator, saying that the star's attorneys had not given Allman enough notice of the court action and refused to share confidential information with him about his case.
