Sia Wins Custody Battle Against Ex Daniel Bernad

Singer Sia on Wednesday garnered a positive outcome in an early chapter of her custody battle with her estranged husband Daniel Bernad over their toddler son Somersault Wonder, who they call Summi.

Bernad on Tuesday entered an emergency court filing asking for full custody of the one-year-old child – accusing the Grammy-nominated singer-songwriter, 49, of drug abuse.

On Wednesday, a Los Angeles judge shut down the request, as Sia’s attorney Laura Wasser successfully argued saying that Bernad hadn’t presented any new or compelling evidence to persuade the court to award him sole custody, according to a court filing reviewed by TMZ.

The judge told Bernad that the information he presented in his argument had already been put before the court two months ago when they established an agreement over temporary physical custody of Summi.

In that arrangement, the Unstoppable artist, whose real name is Sia Kate Isobelle Furler, was awarded primary custody of Summi, with Bernad receiving visits supervised by a monitor. 

Sia had filed for divorce in Los Angeles this past March following a two-year marriage. Daily Mail has reached out to reps for Sia, her lawyer’s office and Bernad’s company for further comment on the story.

An insider on Wednesday told People that the singer – who has past used a mask to guard her privacy in public – had been ‘devastated’ that the situation was making headlines.

‘She’s always been guarded her personal life,’ the source said. ‘She’s heartbroken that her ongoing divorce and custody battle has become public.

‘She’s devastated that something so private has turned into a headline. She’s incredibly protective of her family, and this attention has been very painful for her.’

Bernad had requested full custody of Summi, according to a court filing reviewed by Daily Mail – a request he claimed was justified by Sia’s ongoing battle with drug addiction. 

In the court filing, Bernad claimed that the songstress presented a significant threat to the toddler’s well-being if she was granted custody of the child.

Bernad said in the court filing Sia presented ‘a serious and immediate danger’ to the 19-month-old, characterizing her as an ‘unfit and unreliable parent struggling with substance abuse and addiction.’ 

Bernad asked the court to award him $77,245 in monthly child support, calling Sia’s conduct ‘reckless, dangerous’ and demonstrative of her ‘utter disregard for Summi’s safety and well-being.’

Sia had been hospitalized quietly for two weeks last month, Bernad said in his court filing.

Bernad added in his court filing that a drug test revealed the Cheap Thrills artist had consumed barbiturates and benzodiazepines.

The Adelaide-born musical artist said in a court filing she entered Tuesday that she has maintained six months of sobriety.

The Chandelier performer said that Bernad was making accusations about her drug use that were ‘entirely unfounded and misleading.’

Sia said Bernad had ‘zero evidence’ that the child was in any kind of danger while she was caring for him.

Sia said in a court filing that she’s currently in a drug rehab rehabilitation program that includes regular testing and a sober companion.

Bernad said in his court filing he wanted Sia to be randomly tested for drugs once a week on a regular basis; along with three random tests a month.

Sia said in a court filing that she has past agreed to be drug tested, but Bernad has not, having ‘refused’ to do so.

Sia said in a court filing that it was Bernad whose lifestyle was not compatible with parenting, adding, ‘My recovery has been a cornerstone of my life and one of the primary reasons I chose to separate from Dan.’

Sia added: ‘Dan’s attempt to weaponize my past sobriety journey – an issue long resolved and well-documented – serves no legitimate purpose and is intended only to distort the facts and undermine my credibility before this Court.’

Bernad said in his court filing that Sia’s behavior prompted suspicions of drug use that this past March, when she was ‘disoriented’ at the birthday party of another celebrity. 

Sia was previously in a two-year marriage to filmmaker Erik Anders Lang that ended in 2016.
