Kelly Rutherford was seen with her teenaged son Hermes Gustaf Daniel Giersch in New York City on Wednesday.

The two were side by side at Biosil’s 30th Anniversary Celebration at Fouquet’s New York. Interestingly, Hermes is already taller than his Hollywood actress mother who stands at 5ft8in.

The 18-year-old boy wore a dark suit with a black shirt as his blonde hair was slicked back. He added a long printed scarf.

Mom modeled a long off-white sleeveless dress with a mock neck as she held onto an Hermes Birkin bag in ivory.

The blonde beauty also has a 16-year-old daughter named Helena.

The father of the two kids is Kelly’s ex-husband, German businessman Daniel Giersch, whom she had a very ugly and public international custody war with that cost her over $2M. 

Kelly has been living in Monaco to be closer to her kids.

The TV star had a lengthy custody battle with her ex Daniel. She wed Giersch in 2006 and they split in 2009.

Rutherford was granted joint custody of their children by a judge in Monaco. Hermés was two years old at the time and the star was pregnant with Helena.

Things got hard when the judge said the kids would have to live full-time with Giersch in Monaco because his work visa got revoked.

That kept him from returning to the United States. 

The judge told Rutherford that she would have to move to Monaco or make frequent visits in order to see her two children.

The actress spent nearly $2 million in legal fees, it was claimed. Then she had to declared bankruptcy so she could continue to pay to fight for full custody of her kids.

It was a six-year legal battle.

When she didn’t send her kids back to Monaco following a six-week visit she was accused of abduction.

Kelly last hit a red carpet with her kids in 2015, which was 10 years ago. 

In October she told Travel + Leisure she likes how quiet Monaco is.

‘It’s actually quite peaceful,’ Rutherford said. ‘It’s the opposite of what everyone thinks it is, for me at least. It’s a place you can come and really just be quiet.’

She added, ‘In the wintertime, it’s very quiet, very private, and very peaceful. It’s like the Hamptons in the summer versus the Hamptons in the winter.’

The Melrose Place star has a slower lifestyle there.

‘I just walk the dogs, hang out with the kids, and run errands,’ she said.

‘If there’s a gallery opening or something like that, I’ll go just to see. But it’s mostly just quiet time here for me.’ 

And she loves the history of Monaco.

‘Grace Kelly really created this beautiful feeling here,’ she said. ‘She invited all the Hollywood people to Monaco early on and made it very glamorous.’

Now it is ‘still very old school, traditional, private, beautiful, but it’s also now becoming sort of a cultural center. There’s the feeling like it’s having another new energy.’
