The star, 44, caused a stir last year after but it seems she has not learned her lesson about smoking safety. 

On Wednesday, she was seen puffing her cigarette at a gas station.

Spears sat in the front passenger seat of her Mercedes-Benz, dangling a cigarette out of her cracked-open window as her driver filled up the tank.  

Meanwhile, a sign advising against smoking at the gas station was placed at the pump. 

The Daily Mail has contacted representatives for Spears for comment but did not immediately hear back.

It is not the first time Spears' penchant for smoking has gotten her in trouble. 

Last year she violated federal aviation regulations after she lit a cigarette on board a charter plane from Cabo San Lucas. 

People reported that Spears extinguished the cigarette after being asked by flight attendants. 

Authorities warned Spears about her behavior when she landed in Los Angeles before she was free to leave, the site reported.

Meanwhile, Spears has been sober since her DUI arrest on March 3 in the Westlake Village neighborhood of California, near her mansion.

The Womanizer singer has been regularly attending Alcoholics Anonymous (AA) meetings in the Los Angeles area.

'Britney has been very open and honest in her AA meetings, she has said she loves pouring her heart out as she knows that is the best way to heal and feel better,' a source told The Daily Mail.

'The only thing she has indulged in is fancy coffee drinks. She is being super careful because she wants to be there for her kids.'

The Louisiana native has been catching up on quality time with her sons, Sean and Jayden, lately.

Though the boys have lived in Hawaii, they have been by their mother's side in recent weeks.

'She is very happy that they are close again. It is healing her heart. She loves her sons,' the insider added.

Alcoholics Anonymous is an international, peer-led mutual aid organization dedicated to abstinence-based recovery from alcoholism through a Twelve Step program.

This is not the first time Spears has been in AA.

According to her 2023 memoir, The Woman In Me, she was mandated to attend meetings four times a week during her 13-year conservatorship.

She described the legal arrangement, which was controlled by her father, Jamie Spears, as a restrictive environment.

A representative for Spears said in early March that the singer needs 'help and support' after she was arrested on suspicion of driving under the influence.

The Toxic singer was taken into custody by the California Highway Patrol around 9:30 p.m. on March 3 in Ventura County, with reports saying she was handcuffed on suspicion of DUI and booked around 3:00 a.m. before being released around 6:00 a.m.

Shortly after the news of her arrest broke, a rep told Daily Mail: 'This was an unfortunate incident that is completely inexcusable.

'...[Britney's] boys are going to be spending time with her. Her loved ones are going to come up with an overdue needed plan to set her up for success for wellbeing.'

Ventura County sheriff records show Britney is scheduled to appear in court on May 4.
