Kanye ‘Ye’ West has filed to dismiss a federal sexual assault lawsuit from America’s Next Top Model alum Jenn An, and he accused her of attempting to ‘punish his creative process and censor his art.’

It comes 10 months after the 40-year-old plaintiff sued the 48-year-old rapper-designer and Universal Music Group for violating New York’s Gender Motivated Violence Act by allegedly jamming his fingers down her throat and choking her until she ‘temporarily blacked out.’

Jenn claimed Ye’s alleged assault occurred as she served background acting duties for English synth-pop duo La Roux’s music video for In for the Kill, which took place at the historic Hotel Chelsea in Manhattan back in 2010.

West did not end up appearing in the US-themed second music video, but he was featured on a remix of the Grammy-nominated single by frontwoman Elly Jackson and producer Ben Langmaid.

The self-described feminist alleged Ye strangled her with both hands, smothered her face with his hands, and rammed several fingers in and out of her throat simulating ‘forced oral sex’ for a full minute.

West then allegedly screamed: ‘This is art. This is f***ing art. I am like Picasso.’

Jenn also claimed to overhear Elly Jackson telling a friend that she’d seen some ‘upsetting, unsettling’ behavior during the ‘classy yet sleazy’ shoot directed by LEGS.

‘Like many thousands of stage performances and motion pictures before it, [the In for the Kill video] included physical touching between the actors (here, West and An),’ the Bomb rapper’s attorney argued on Monday.

‘At no point during the production did she object to her role, express a lack of consent to participate, nor attempt to leave the performance, nor does she claim such in her [lawsuit].’

Ye’s lawyer continued: ‘To permit such claims to proceed would mean that every actor, director, and artist involved in provocative film, theatre, or music video productions — whether depicting violence, sexuality, or both — could face retroactive criminalization and personal liability whenever a performer later regrets or reimagines their participation.’

Jenn has requested a trial by jury for punitive damages, legal fees, as well as ‘damages for mental, emotional and physical injury, distress, pain and suffering and injury to reputation.’
